Introduction

Welcome to Tigarly. These Terms of Service ("Terms") govern your access to and use of tigarly.com (the "Site"), which is operated by Tigarly LLC ("Tigarly," "we," "our," or "us"), as well as purchases of products and use of services made available through the Site.

By accessing the Site, using our services, or placing an order, you agree to be bound by these Terms and any policies incorporated into them by reference. If you do not agree with these Terms, you should not use the Site or place an order.

Online Store Terms

By using this Site or placing an order, you represent that you are at least the age of majority in your state of residence and have the legal capacity to enter into a binding agreement.

You may not use our products, Site, or services for any illegal, fraudulent, or unauthorized purpose, nor may you violate any applicable laws or regulations while using the Site.

You must not transmit viruses, worms, malicious code, or any other technology intended to damage, interfere with, or disrupt the Site or related services.

A breach or violation of these Terms may result in suspension or termination of your access to the Site or services.

General Conditions

We reserve the right to refuse service, cancel transactions, or restrict access to the Site where reasonably necessary, including in cases involving suspected fraud, abuse, unlawful activity, payment issues, product availability, or violations of these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, distribute, exploit, or commercially use any portion of the Site or services without prior written authorization from Tigarly LLC, except as permitted by applicable law.

Accuracy, Completeness and Timeliness of Information

We make reasonable efforts to provide accurate and current information on the Site. However, product descriptions, specifications, dimensions, colors, images, prices, availability, and other information may occasionally contain typographical errors, inaccuracies, or omissions.

We reserve the right to correct errors, update information, modify content, or cancel orders affected by material pricing or product information errors where permitted by applicable law.

Information displayed on the Site may be updated from time to time without prior notice.

Products and Services

Certain products and services may be available exclusively through the Site and may have limited availability.

We make reasonable efforts to display product colors, materials, finishes, dimensions, photographs, and other characteristics as accurately as possible. However, actual appearance may vary slightly due to monitor settings, photography, lighting conditions, manufacturing tolerances, or natural variations in materials.

Product prices, specifications, availability, and descriptions may be changed or updated when reasonably necessary.

We reserve the right to limit quantities, discontinue products, or restrict sales where permitted by applicable law.

Pricing and Payment

All prices displayed on the Site are stated in U.S. dollars unless otherwise indicated.

Applicable sales tax and other legally required charges, if any, will be calculated and displayed during checkout based on the information provided and applicable law.

Payment transactions are processed through Shopify and/or authorized third-party payment providers. Tigarly LLC does not directly store complete payment card numbers on its own systems.

Accuracy of Billing and Account Information

You agree to provide current, complete, and accurate billing, shipping, contact, and account information for all purchases made through the Site.

We reserve the right to refuse or cancel an order where reasonably necessary, including orders that appear fraudulent, unauthorized, incorrectly priced, unavailable, or intended for unauthorized resale.

If we make a material change to or cancel an order, we may attempt to notify you using the email address, phone number, or other contact information provided with the order.

Shipping and Delivery

Tigarly LLC currently ships orders within the United States and does not currently offer international shipping.

Processing times, estimated transit times, shipping costs, delivery restrictions, signature requirements, and other shipping conditions are described in our Shipping Policy.

Delivery dates are estimates and may be affected by carrier delays, weather, transportation disruptions, incorrect shipping information, peak demand periods, or other circumstances outside our reasonable control.

Returns and Refunds

Eligible returns, exchanges, damaged-item claims, and refunds are governed by our Returns & Refunds Policy.

Please review the Returns & Refunds Policy before making a purchase. Return eligibility may depend on factors including the return request date, product condition, installation status, original packaging, and other requirements described in that policy.

2-Year Limited Manufacturer Warranty

Eligible Tigarly LLC lighting fixtures are covered by our 2-Year Limited Manufacturer Warranty against qualifying defects in materials and workmanship, subject to the warranty terms, limitations, exclusions, and eligibility requirements stated on our Site.

The warranty does not cover damage resulting from improper installation, misuse, abuse, unauthorized modification, improper maintenance, accidents, normal wear and tear, environmental conditions, or other causes that are not qualifying manufacturing defects.

Professional installation by a qualified electrician is recommended where appropriate and may be required by applicable electrical codes.

User Comments, Feedback and Other Submissions

If you submit reviews, comments, suggestions, ideas, photographs, feedback, or other materials to us, you represent that you have the right to provide such materials and that your submission does not violate applicable law or the rights of another person.

Where permitted by applicable law, you grant Tigarly LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, and distribute voluntarily submitted content for legitimate business purposes, including customer service, Site operation, and marketing.

We may remove content that we reasonably determine to be unlawful, abusive, defamatory, obscene, fraudulent, infringing, or otherwise inappropriate.

Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, applications, payment providers, analytics services, shipping providers, or other services that are not operated by Tigarly LLC.

We are not responsible for the content, security, availability, privacy practices, or policies of third-party services. Your use of third-party services may be subject to separate terms and policies established by those providers.

Intellectual Property

Unless otherwise stated, original Site content owned or lawfully used by Tigarly LLC, including text, graphics, logos, design elements, photographs, product presentation materials, and other original content, may be protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use protected Site content without prior authorization from the applicable rights holder, except as permitted by law.

Third-party trademarks, trade names, photographs, product names, and other intellectual property remain the property of their respective owners where applicable.

Disclaimer of Warranties

Except for the 2-Year Limited Manufacturer Warranty expressly provided by Tigarly LLC and any warranties or consumer rights that cannot lawfully be excluded, the Site and related services are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.

We do not guarantee that access to the Site will always be uninterrupted, timely, secure, or error-free, or that every technical issue will be corrected immediately.

Nothing in these Terms is intended to exclude, restrict, or modify any warranty, guarantee, statutory right, or consumer protection that cannot legally be excluded or limited.

Limitation of Liability

To the maximum extent permitted by applicable law, Tigarly LLC and its officers, employees, affiliates, agents, contractors, service providers, suppliers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to your use of the Site or services.

These limitations do not apply where liability cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Tigarly LLC and its affiliates, officers, employees, agents, contractors, service providers, and suppliers from claims, liabilities, damages, losses, or reasonable expenses arising from your unlawful use of the Site, your material breach of these Terms, or your violation of the rights of another party.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in full force and effect.

Termination

These Terms remain effective while you use the Site or services.

We may suspend or terminate access to the Site where reasonably necessary because of a material violation of these Terms, unlawful conduct, fraud, abuse, or security concerns.

Provisions that by their nature should survive termination will remain effective after termination.

Entire Agreement

These Terms, together with the policies and notices incorporated by reference on the Site, constitute the agreement between you and Tigarly LLC regarding your use of the Site and related services, subject to applicable law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

Governing Law

These Terms and any separate agreements through which Tigarly LLC provides services will be governed by and construed in accordance with the laws of the State of California, United States, without limiting any consumer rights that may apply under mandatory law.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices, Site functionality, or applicable legal and regulatory requirements.

The most current version of these Terms will be posted on this page. When material changes are made, the "Last Updated" date may be revised accordingly.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
